General Terms
Art. 1 : OBJET
General conditions define the rights and contractual obligations of the seller and his customers and the conditions applicable to all purchases made through the vendor’s site. the client either professional or consumer.
Any customer is deemed to have read the terms and conditions and declares subscribe without reservation. Therefore, any order is sent to these terms of sale, to the exclusion of all other general conditions to which reference would be made
The seller reserves the right to modify terms and conditions at any time. In this case , the applicable conditions are those in effect on the date of the customer’s order .
Art. 2 : Products
The proposed products listed in the catalog published on the seller’s website , accompanied by a description.
They are proposed subject to availability. If, however , some products are unavailable , the seller will inform the customer as soon as possible and offer him the opportunity to either cancel his order without charge or wait until availability.
Some products consist of limited editions, which are available in 200 copies by printing support and size of which 100 editions in format 120 x 120 cm and 100 editions in format 180 x 120 cm.
These limited editions are available on the three proposed media editions but only on the media in acrylic and brushed aluminum dibond or are accompanied by a numbered certificate of authenticity.
This certificate is sent separately in .pdf document trough e-mail.
The gift certificates are valid for a period of one year and may be used only once. They are not refundable.
Art. 3 : Prices
Product prices are displayed on the site in euros, VAT included and delivery costs excluded.
The seller reserves the right to change prices at any time.
Prices applicable are those in force upon confirmation of the order.
Art. 4 : Payments
Payment are made trough Paypal , Visa and Mastercard.
Ownership of the sold product passes to the customer only after full payment of the amounts due .
Meanwhile , the customer for safekeeping and can neither alienate nor transform .
Art. 5 : Territory
Cars and Roses sells his works in Belgium, France , Netherlands , Luxembourg , USA and UK .
Art. 6 : Order
The customer who places an order , fills an identification sheet containing all the requested details.
After checking , confirmed and paid for the order, the customer receives a confirmation e- mail with the number of the order.
The confirmation of the order implies acceptance of these terms and conditions.
Art. 7 : Delivery
Deliveries are made to the address on the identification form filled by the customer.
The product always travel to the risks and dangers of the customer to which it belongs immediately to its reserves with the carrier in the event the package sent to it in deteriorated packaging.
All other claims must be made by registered mail sent to the seller’s office within 48 hours of receiving the product , under penalty of being excluded.
Shipping fees are calculated depending on the destination , size and weight of the product .
Delivery times are never mentioned for illustrative purposes only and are not to the seller no firm commitment . Non-observance can in no case allow the client to avoid the performance of its obligations to seek termination of the contract or to claim damages.
Art. 8 : Retraction
The customer has a period of 14 days to withdraw without having to justify its decision and incur support costs other than the direct cost of returning the product.
The withdrawal period expires after a period of 14 days from the day when the customer takes physical possession of the property.
The customer informs the seller before the expiration of the withdrawal period, of its decision to withdraw from the contract and will contact the seller’s customer service at info@carsandroses.com to secure the return of the product characteristics.
The customer returns the product without undue delay and in any event within fourteen days following the communication of its decision to withdraw.
This deadline is met if the customer returns the product before the expiry of 14 days.
The seller refund the payment received after receipt of the product and within 15 days.
The product must be returned in its original packaging, undamaged. Failing this, it will be returned or refunded.
The responsibility of the customer is liable for any depreciation of the product resulting from improper handling of the product. In this case, no refund will be granted.
This section does not apply to professional customers.
Art. 9 : Guarantee
The seller shall be liable in respect of the customer for any lack of conformity which exists upon delivery of the product used for non-business purposes and that appears within two years of it in accordance with Articles 1649 bis and according to the civil Code.
Art. 10 : Responsability
The seller is required as part of the online sale by an obligation of means .
His liability can not be pledged for damages resulting from the use of the Internet as without this limitation, service disruption , data loss , viruses , …
All data, all links included on the website are given in good faith.
The force majeure release the seller of right and without compensation of any kind of responsibility for the contract.
Art. 11 : Intellectual Property
All Vendor site elements are and remain the exclusive intellectual property of it .
Any reproduction, copying , redistribution, modification, use parts of the site they are software, visual or sound in any capacity whatsoever, even partially is strictly prohibited without the prior written consent of the seller.
Art. 12 : Protection of Personal Data
All personal data required to process an order are retained by the seller and may be transmitted to companies with which the vendor is working , when such communication is necessary for processing the order.
The customer agrees to receive offers from the seller and / or its partners.
Personal data is stored to facilitate future orders.
For the rest, the seller agrees not to disclose the information available to another company or another company.
At any time, the customer can request the vendor to correct its data.
Art. 13 : Litigation
These general conditions are governed by Belgian law. In case of dispute , the Courts of the judicial district of the seller’s registered office are competent.
